Builder penalized for violating California workers' comp laws | San ...

California officials recently suspended the license of a builder for failing to comply with workers' compensation laws. Unfortunately, this action came too late for a carpenter who was tragically buried alive while working on a home in Milpitas the previous weekend.

In an announcement on Feb. 3, the Contractors State License Board stated that US-Sino Investment, Inc.'s general building contractor license was suspended. The Board took action because the builder was not in compliance with California workers' compensation insurance requirements.

The Board went on to explain that all licensed contractors must have workers' compensation insurance for all of their employees. US-Sino Investment had stated it had no employees and claimed an exemption.

The Board Registrar said in a statement that, "Those who fail to properly protect their employees with workers' compensation insurance not only put them at risk, but undermine the integrity of the entire construction industry."

The Board further explained that workers' compensation laws are there to protect workers, but also serve the purpose of shielding consumers from liability for workplace injuries.

Officials from the California Division of Occupational Safety and Health (Cal/OSHA), stated that the builder also did not have the appropriate permit to work on the home. Additionally, a stop-work order was issued by city officials three days prior to the accident due to concerns about the rain-saturated hillside.

All these actions, however, failed to prevent the death of a worker. The carpenter died after he was buried alive in a trench 12 feet deep. The chief building inspector for Milpitas has been unable to reach the CEO of U.S. Sino Investment.
